Cancellation Policy

• Cancel more than 36 hours before your booking's start time and you'll receive a full refund to your original payment method.
• Cancel within 36 hours of the start time and a 20% cancellation fee applies; the remaining 80% is refunded to your original payment method.
• To cancel, email us at book@luxurybeachsetupfl.com with your name, your booking date, and the reason for canceling. During our operating season (October 5th through May 31st), we reply to every message within 4 hours.

Booking and Reservations

Booking Process

You can reserve online, by phone, or by email. Every service is paid in full at the time you book.

Confirmation

A booking isn't final until we've received payment and sent you a text confirmation.

Availability

Services and equipment are offered subject to availability. If we're unable to accommodate your request, we'll reach out promptly with other options.

Rental Items

• While equipment is in your hands during the service period, it's your responsibility to use and care for it properly.
• Each item should be used only for its intended purpose and in line with our Rental Agreement and Rain Policy.
• If something is damaged or lost, you cover the repair or replacement cost as spelled out in the Rental Agreement.

Customer Conduct

• Please treat the equipment and facilities provided by Luxury Beach Setup Co with respect.
• We ask that you be courteous toward other guests and our team.
• Luxury Beach Setup Co does not tolerate illegal, harmful, reckless, or dangerous behavior.
• Follow all local laws and regulations on smoking and alcohol wherever you're set up.

Safety and Liability

Assumption of Risk & Liability Waiver

A day at the beach carries built-in risks - among them exposure to sun, wind, and water; uneven terrain; physical activity; and the use of beach equipment. By booking or using our services, you voluntarily take on all such risks.

You agree to release, indemnify, and hold harmless Luxury Beach Setup Co FL LLC, along with its owners, employees, and contractors, from any and all claims, losses, damages, or liability - including third-party claims - arising from: (a) your use of rented equipment; (b) injury to you, anyone in your party, or bystanders during the service period; (c) damage to personal property; or (d) beach conditions beyond our control, such as weather, tides, and sand conditions.

This waiver applies to the fullest extent the law allows. Should any provision of it be found unenforceable, every remaining provision stays in full effect.

Equipment Safety

Keep an eye on the safety of your setup throughout the day. If a piece of equipment becomes unstable or the weather turns, secure or leave the setup right away and let our team know. Luxury Beach Setup Co is not liable for injuries that result from misusing equipment or from failing to follow safety instructions.

Third-Party Injuries

It's on you to make sure your rented equipment doesn't endanger anyone in your party or anyone nearby. Luxury Beach Setup Co is not liable for injuries to third parties caused by a renter's negligence or by a failure to maintain the setup area.

Age Restrictions

You must be at least 18 years old to book or rent equipment. Anyone under 18 may use our services only while directly supervised by a responsible adult who has agreed to these Terms & Conditions.

Multi-Day & Weekly Packages

Multi-day and weekly packages run across consecutive days of service at a single location. These terms apply to every multi-day booking:

• Our crew performs a full setup and a full breakdown every single day. You don't keep or store any equipment overnight - all gear is collected at the end of each day.
• We treat each day as its own standalone service. If a day is lost to weather, the Rain Policy covers that specific day.
• Cancel a multi-day package more than 36 hours before the first scheduled day for a full refund. Within 36 hours of the first day, the standard 20% fee applies to the full package price.
• Once a package has begun, individual days can't be dropped for a partial refund - the only exception is a weather cancellation handled under the Rain Policy.
• Packages can't be transferred to another customer or location unless Luxury Beach Setup Co approves it in advance.

SMS Communications Consent

1. SMS Consent & Twilio Compliance

Luxury Beach Setup Co's SMS program follows the Telephone Consumer Protection Act (TCPA) and every applicable carrier requirement, including those of our SMS provider, Twilio. We only text customers who have voluntarily opted in to receive messages. When you opt in, you may also get the occasional promotion, special offer, or service announcement. We never sell or share your phone number or SMS opt-in details with third parties or affiliates for their own marketing or promotional purposes.

2. Types of SMS Communications

Once you've opted in to texts from Luxury Beach Setup Co, the messages you receive may cover:

• Booking confirmations and reservation reminders
• Setup details, day-of coordination, and location updates
• Schedule changes and weather-related alerts
• Customer support and replies to your questions
• Occasional promotions, special offers, and service announcements

Example: "Hi! Just a reminder about your Luxury Beach Setup Co booking this Saturday at 9:00am. Reply STOP to opt out."

3. Message Frequency

How often you hear from us depends on your bookings, your service activity, and your messaging preferences. Message and data rates may apply.

4. Potential Fees

Depending on your carrier's plan, standard message and data rates may apply. Those charges come from your carrier, not from Luxury Beach Setup Co.

5. Opt-In Method

You can opt in through the optional, unchecked SMS consent box on our website or booking forms. Marketing consent is gathered separately from booking-related SMS consent, and agreeing to texts is never a condition of purchase.

6. Opt-Out Method

Reply "STOP" at any time to unsubscribe from the relevant SMS communications. You'll get a single confirmation message and no further texts after that. You can also email us at book@luxurybeachsetupfl.com to be removed from our messaging list.

8. Standard Messaging Disclosures

Terms of Agreement

Booking, renting, or using any service provided by Luxury Beach Setup Co means you agree to follow these Terms & Conditions. They govern your use of our services and any interactions you have with us.
